What is it?
There are a number of forms of Alternative Dispute Resolution (ADR) aimed at parties avoiding the need to take their differences to court. Mediation is one form of ADR with qualities which makes it particularly appropriate for rural, family and business disputes.
Mediation comprises:
- a party led and voluntary process
- the negotiation of a settlement by the parties within an environment controlled by the mediator
- a mixture of open and confidential private sessions
- a “without prejudice” process which means what is discussed cannot be disclosed to a court
- a non-judgmental process
The mediator assists the parties to find their own solution to their own problems. Most alternatives to mediation impose a judgement/solution on the parties whilst mediation allows for a much more imaginative agreement to be reached.
